Captain’s Club Membership

The First Mate Captain’s Club membership includes a wide range of attractive benefits. Eligibility for your membership is contingent on your membership having been in good standing for at least six months. As part of our Captain’s Club, we will provide you with the necessary labor and materials to perform system checks for your heating and cooling system. Pricing does not include separate dispatch fees, repairs, or other services. The Company will use ordinary care in performing the tasks. We do not guarantee the condition of the equipment and cannot eliminate obsolescence or normal wear.

• Annual System Check Visits: The Captain’s Club includes annual system checks for your heating and cooling system. We will attempt to contact you by mail, phone, or email to schedule your visits. If you fail to take advantage of these benefits, these annual visits are lost for the applicable period and have no monetary value.
• Ongoing Membership: Your membership will continue to automatically renew month to month or annually unless you cancel your membership, or we terminate it.
• Discount Benefits: Discount benefits received prior to the end of the first six months of membership may be subject to a charge-back in the event of membership cancellation.
• Recurring Billing: By starting your Captain’s Club membership and providing a payment method, you authorize us to charge a monthly membership price at the then-current price or trail price by either Automatic Credit Card Debit or Automatic Bank Draft. The customer understands that the monthly fee will continue until a written notice of cancellation is received by our corporate office.
• Customer Right to Cancel: Customer may cancel this agreement at any time by sending us a written email at office@callfirstmate.com. Once received by the company, the customer will receive a cancellation confirmation. Membership is in full effect until the customer receives a cancellation confirmation.
• Company Right to Cancel: Company reserves the right to immediately terminate this agreement at our sole discretion. Transferability: If the customer moves, this agreement is transferable to their new home as long as the new home is still within the company’s service area or leave to the new owner.
• Billing Cycles: The first monthly payment is collected at the time of service. Afterwards, monthly payments will be collected monthly (day of month may vary). Annual Payments will be collected 1 Year after initial purchase automatically unless Cancellation is requested prior to Billng Cycle.
• Benefits Use: Captain’s Club membership benefits are not for resale and not redeemable in cash. Any unused portion of your benefits is not refundable.
• Warranty: Warranty will be made invalid if another company or individual performs work on equipment installed by First Mate.
• Miscellaneous: Pricing and other terms subject to change without notice. See actual invoice or estimate for exact pricing. In such an event, the company will attempt to notify you before any price increase occurs.
• Limitation of Liability: UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, ANY SERVICES PROVIDED UNDER THIS AGREEMENT. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OF EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL OUR TOTAL LIABILITY, TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF (WHETHER IN CONTRACT, TORT INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR YOUR SUBSCRIPTION.
